‘What can I do if I receive a debt settlement offer from Amex?’ is a question that some heavily indebted Americans may be asking themselves at this very moment. The easy answer is of course, to accept it, but wait! Things are hardly ever as simple, especially when it comes to financial matters.

American Express, commonly known as Amex, is a global financial service company and has been listed as one of the top 30 Most Admired Companies in the World by Fortune. Given this high power background, you may find yourself asking if a debt settlement offer from Amex is valid. If your account has been delinquent and debt payments have been long overdue, then yes, Amex may just do that. In fact, most lenders or creditors would be quite willing to settle your debts if you are in a deep financial distress where your next best option is to announce bankruptcy. When you do that, none of your lenders or creditors will be able to collect a single penny from you, which is why it is usually in their best interest to settle with you.


Debt settlement is also sometimes known as debt negotiation. In a scenario when you are no longer able to make the monthly minimum payment, even with lowered interest rates and waivered late fees, you may opt to negotiate with your creditors to settle the debts. The settled amount is usually lower than the total amount owed, but is acceptable to both the creditor and yourself. Bear in mind that Amex, or any other creditor for that matter, will generally not consider debt settlement if you are current on your payments. In most cases, the longer your account has been past due, the better settlement you are likely to receive.

As mentioned earlier, debt settlement is not a simple matter. Be sure to call Amex first to ensure that they are still your assigned creditor, as they typically charge off delinquent accounts after 6 months although it could be as early as 90 days too. After the charge off, you would not be dealing with Amex anymore, but more likely a third party debt collection agency. Even if Amex has extended a settlement offer to you, there is a chance that you may still negotiate further. Settlement offer can usually range from as low as 20% to 85%, depending on the creditor, your credit rating and the account’s delinquency. Your initial offer may be rejected but don’t give in; instead continue to propose until both parties can reach to an agreeable offer. You may want to be prepared for such negotiation to last for a few days, perhaps even weeks.

Don’t worry if the majority of your debt is made up of credit card debts – you may still settle these debts. However, you should know that credit card settlement ordinarily only involves the debts incurred from credit cards. If you have other debts that you wish to settle, you would probably need to do it in another settlement. Again, take your time to discuss about the settlement offer with your creditor until you reach an agreement. Another question that is often asked is whether one should do this on one’s own or to hire a professional. This really depends on the individual. The upside of getting professional help is that they are more likely to know how much a creditor is willing to settle for and how to go about doing it. Some negotiators will assist you for a small fee, but there are non-profit agencies that provide such service free of charge too.

Christchurch can host 2011 Rugby World Cup final

Christchurch, New Zealand‘s Jade stadium says they can host the 2011 Rugby World Cup final if Auckland can’t make a decision on whether or not they should build a new stadium on the waterfront or upgrade Auckland’s current stadium, Eden Park, costing NZ$500 million and $385 million respectively.

Jade Stadium would be able to host the final if they were to include temporary seating to accommodate 60,000 people, required by the International Rugby Board (IRB).

Gary Moore, mayor of Christchurch, said that if they were selected to host the final then they will ask the government for $80 million. The stadium is already planning for an upgrade, worth $60 million but that money will be funded from private and charitable organisations as well as the local and central governments. The current upgrade will see Jade stadium’s seating capacity grow to 43,000 and if they host a quarter-final or semi-final then temporary seating will increase the seats to 55,000.

Trevor Mallard, the Minister of Sport, said that the Auckland City Council and the Auckland Regional Council have both been given about two weeks to tell the government which decision it supports. If they cannot come to a decision then the final will most likely be given to Jade stadium, Christchurch. The least likeliest of all decisions, an upgrade of Carlaw park, but that is designated for a retirement home and on private land.

Mr Moore said that he and “stadium officials had offered Jade Stadium as a back-up final venue at a recent informal meeting with Mallard because of the continuing Auckland divisions over a site. This is about New Zealand Inc, not about Christchurch versus Auckland. What we have said to Trevor Mallard is we are able to put a stadium into Christchurch that would accommodate the numbers they would need as an insurance policy if Auckland cannot get its act together. The Government knows that when Christchurch or Canterbury puts its hand up it delivers with excellence.”

Bryan Pearson, chief executive of Vbase, the company which manages Jade Stadium, said: “It was not uncommon for major sporting venues to add temporary seating for big events. London had included temporary seating for some stadiums as part of its successful Olympic hosting bid. It was not a low-rent option, and was a commercially prudent way to marry short-term opportunity with long-term legacy.”

Mr Pearson hopes that Jade Stadium will not be used for the final as he understands why the government wants a national stadium, “Let’s hope this gets sorted and we can focus our attentions on playing a very major supporting role. We are only a third the size of Auckland, so what we can sustain post-World Cup is nowhere near what Auckland can.”

Warwick Taylor, former All Black, said it will be great if Christchurch can host the final even though he played in the 1987 final at Eden Park. Though Mr Taylor does say that an Auckland stadium is a better idea as a 60,000 seat stadium is more viable in such a large population city. Mr Taylor said that he “had great memories playing at Eden Park and in some ways would hate to see it lose the final. But I also like the idea of a national stadium.”

The New Zealand Rugby Union said that a waterfront stadium and an upgrade of Eden Park are the only two options being considered, and no other stadiums are being considered.

A lot of people are confirming that Christchurch will be able to cope with the huge amount of visitors that would arrive for the final as Christchurch has the highest per capita amount of restaurants and bars in Australasia. The city also features numerous hotels.

If New Zealand cannot deliver a final in a 60,000 seat World Class stadium then the IRB will allocated the final to another country.

The Swedish organization Antipiratbyrån (The Swedish Anti-Piracy Bureau) suffered a massive blow today when the Swedish government’s Data Inspection Board stated that the Bureau’s storage of Internet user’s IP addresses is illegal.

Antipiratbyrån is an organization representing the movie and software industry in Sweden, working to protect the intellectual property of its beneficiaries. This spring they started collecting IP-addresses of suspected copyright infringers. They used the collected information to press charges and to contact the suspect’s Internet service providers, demanding repercussions.

The Data Inspection Board’s press release established that the collection of IP-addresses is in fact a violation of the Swedish Personal Data Law, prohibiting electronic storage of information about individuals without their consent.

– If they don’t cease with the activities we might follow up with a penalty order, the supervising director Britt Marie Wester at the Data Inspection Board says to TT.

Both the Swedish organization Piratbyrån – celebrating the verdict as a great victory – and the CEO of Jens of Sweden – a Swedish manufacturer of MP3-players – have stated that they might file a class action suit against the Anti-Piracy Bureau, together with the individuals registered.

Fuel leak prompts 17,000-vehicle recall by Toyota

Toyota announced on Friday that it will recall around 17,000 Lexus vehicles in response to risks of the fuel tank in the cars leaking after a collision.

The Lexus HS 250h model was subjected to the recall following a US National Highway Traffic Safety Administration (NHTSA) investigation. Despite previously passing Toyota safety inspections, the conclusions of an NHTSA sub-contracted investigator were that; when the vehicles in question collided with an object at more than fifty-miles-per hour, more than 142 grams of fuel, the maximum allowed by US law, leaked from the crashed car.

According to Toyota, further tests did not show any additional failure of the fuel tank.

In response to the findings, Toyota issued a recall of all affected vehicles, since the company had no solution immediately available. The recall includes 13,000 cars already sold, as well as another 4,000 still at dealerships.

Toyota says it plans to conduct further tests to determine the cause of the leak. A Toyota spokesman, Brian Lyons, said that the company was “still working to determine what the root cause of the condition is.” It’s still unclear when exactly the recall will take place, or when dealerships will be allowed to sell this model again. Lyons said that Toyota is “working feverishly to get this resolved as soon as possible.”

Toyota isn’t aware of any accidents stemming from the leaking fuel tank in the affected vehicles, first introduced in the summer of 2009.

Christine Comer, former director of the science curriculum for the Texas Education Agency (TEA), is suing the Commissioner Robert Scott for wrongful dismissal. Comer alleges that she was “illegally fired for forwarding an e-mail about a lecture that was critical of the teaching of intelligent design in science classes.” Her suit alleges she was “terminated for contravening an unconstitutional policy” which required “employees to be neutral on the subject of creationism – the biblical interpretation of the origin of humans.”

The Dallas Morning News reported, “The policy was in force even though the federal courts have ruled that teaching creationism as science in public schools is illegal under U.S. Constitution’s provision preventing government establishment or endorsement of religious beliefs.” Among Comer’s supporters is Philosopher and National Center for Science Education speaker Barbara Forrest who was the presenter at the lecture Comer mentioned in the email.

Buffalo, New York —A three alarm fire at a house owned by John and Evelyn Bencinich, two of the initiators of a lawsuit filed against the Elmwood Village Hotel proposal in Buffalo, required firefighters to rescue eight cats and two dogs in Buffalo, New York today.

At about 8:30 (eastern time) firefighters were called to the home on 48 Granger Place to put out a fire that had started in the basement. It quickly spread to the first floor where the main bathroom was destroyed. The fire did not spread to the second floor or attic.

Initial calls said that many animals were inside the house and firefighters quickly worked to rescue all the cats and dogs. At least one cat and one dog had to receive CPR and oxygen, but both are reported to be in stable condition. At least 3 cats are unaccounted for, but after a search of the house, the cats were not believed to have been inside at the time the fire started.

One elderly woman, Anna Bencinich, the mother of Evelyn, was rescued by neighbors who helped her from the burning house.

“There was smoke all over the house. The fire started in the basement and spread to a small portion of the first floor. Two firefighters were injured while fighting the fire and were transported to Erie County Medical Center,” said Division Fire Chief Thomas Ashe who also said that sections of the kitchen wall at the back of the house had to be torn out to stop the fire from spreading through the walls.

One firefighter is being treated for bite injuries to his face that he received while attempting to rescue a dog. The other firefighter was treated for injuries he received to his hand, which was believed to have been caused by glass or a cat scratching him. The names of the injured firefighters are not known. The injuries are said to not be life threatening.

According to witness reports, the home owners had a new water heater installed just last week, but it is not known if the fire was caused by the heater.

“We believe the fire was caused by an electrical (malfunction). An investigation is being conducted,” said Battalion Chief Joe Fahey who also added that they did not believe arson was the cause.
